Your Landlords’ Agents at Buffalo City Living, LLC want to wish you a Happy New Year and provide you with some important informational updates.
The big updates this month pertain to the recent passage of New York State’s “COVID-19 Emergency Eviction and Foreclosure Prevention Act of 2020.” The Act (S.9114/A.11181) prevents some residential evictions and foreclosures under certain circumstances until May 1st, 2021. How the Act affects Residential Evictions:
Tenants must submit a hardship declaration, or a document explaining the source of the hardship, to prevent evictions. Landlords can evict tenants that are creating safety or health hazards for other tenants, and those tenants who do not submit hardship declarations.
- In accordance with NY State Law, Buffalo City Living, LLC will temporarily modify our eviction procedures as follows until May 1st, 2021:
- If a tenant has a past due balance less than one full month’s rent, they will automatically be approved for a payment plan that allows the tenant until the end of the current calendar month to pay their balance.
- If a tenant has a past due balance greater than or equal to one full month’s rent, the tenant will receive a 14-day written demand for payment of past due rent. The tenant then has 14 days to avoid eviction by exercising one of the following 3 options:
- pay the total rent due
- surrender up the possession of the premises to the Landlord’s Agent
- email admin@buffalocityliving.com with documentation (proof) of COVID19-related hardship AND a payment plan schedule for getting caught up on past, current and future rent by May 1st, 2021.
- Evictions for reasons other than non-payment will proceed normally, as allowed by law.
How the Act affects Residential Foreclosure Proceedings:
Homeowners and small landlords who own 10 or fewer residential dwellings can file hardship declarations with their mortgage lender, other foreclosing party or a court that would prevent a foreclosure.
Regarding Company Coronavirus (COVID19) Policies:
Our office has received a few complaints about some residents and visitors not complying with COVID19 policies. Please remember to wear masks at all times, keep a minimum 6 feet distance from others, and sanitize any touched surfaces when hosting visitors or visiting our rental homes.
