Buffalo City Living, LLC Terms of Business

PAYMENT

Payment in full is required to secure services at $300 and under. Work will not start without payment in full.
An advance deposit of 50% is required to secure services over $300. Work will not start without a deposit.
The remaining balance will be due upon completion and before delivering any product.
Electronic invoices will be sent via email; PayPal, Visa, and MasterCard accepted.
Other payment terms are available upon request & credit verification.
Any account exceeding Net Terms will be subject to a monthly service charge of 1.5%.
Buffalo City Living, LLC shall have a lien on all clients' materials until full payment for any due or outstanding account is received.

BILLING

Customers will be billed for actual services rendered.
Invoices are issued by, and payments made to: Buffalo City Living, LLC, 71 North Park Ave, Buffalo, NY 14216 USA.

PRICING

PRODUCTS PROCUREMENT

Any products that require physical delivery will be purchased on client's behalf using funds made available to Buffalo City Living, LLC. "Product Procurement Budget" includes the sale price of physical goods, plus procurement agent fees. Buffalo City Living, LLC acts solely in the capacity of a procurement agent, and does not engage in the sale or resale of physical goods.

GUARANTEE

Buffalo City Living, LLC guarantees work performed unconditionally against defects in quality and workmanship.
Buffalo City Living, LLC limits liability to fix or refund (at our option) money for services performed, providing that the product is deemed defective by reason of workmanship. No credit will be given if more than thirty (30) days after delivery of product or service.
Buffalo City Living, LLC does not guarantee, and will not be held liable, for defects or damages caused by services purchased by the client from firms other than Buffalo City Living, LLC, or goods procured by any agent other than Buffalo City Living, LLC.
Buffalo City Living, LLC assumes no risk and makes no guarantee for the security of clients' material in production, storage, or delivery, or for delivery schedules, arrival times, delay, or detention of materials prepared for clients.
Client assumes sole responsibility for above mentioned risks.

DISPUTES

You will resolve any claim, cause of action or dispute ("claim") you have with us arising out of or relating to these terms or Buffalo City Living, LLC exclusively in a state or federal court located in Erie County. The laws of the State of New York will govern this Statement, as well as any claim that might arise between you and us, without regard to conflict of law provisions. You agree to submit to the personal jurisdiction of the courts located in Erie County, New York for the purpose of litigating all such claims.
If anyone brings a claim against us related to your actions, content or information, you will indemnify and hold us harmless from and against all damages, losses, and expenses of any kind (including reasonable legal fees and costs) related to such claim.
